Gizlilik ve KVKK Aydınlatma Metni

1. Veri sorumlusu
6698 sayılı Kişisel Verilerin Korunması Kanunu (“KVKK”) kapsamında veri sorumlusu: Pictoreel – Süleyman Tetik, e-posta: info@pictoreel.com.
2. İşlenen kişisel veriler
- Kimlik ve iletişim: ad, e-posta adresi, telefon / WhatsApp numarası
- Talep bilgileri: kategori, mesajınız, sizi öneren kişinin adı
- Görsel veriler: WhatsApp üzerinden gönderdiğiniz araç veya mülk fotoğrafları
- Teknik veriler: sitenin barındırılması sırasında oluşan IP adresi ve tarayıcı bilgileri (sunucu kayıtları)
3. İşleme amaçları ve hukuki sebepler
- Talebinizi değerlendirmek, size dönüş yapmak ve videonuzu üretip teslim etmek — bir sözleşmenin kurulması veya ifası (KVKK m. 5/2-c).
- Öneri (referans) sisteminde komisyonun doğru kişiye atanması — meşru menfaat (KVKK m. 5/2-f).
- Sitenin güvenli ve çalışır durumda tutulması — meşru menfaat (KVKK m. 5/2-f).
Fotoğraflarınız yalnızca sizin videonuzu üretmek için kullanılır. Açık izniniz olmadan reklam veya örnek olarak yayınlanmaz.
4. Verilerin aktarıldığı taraflar
Hizmeti sunabilmek için aşağıdaki hizmet sağlayıcılarla çalışıyoruz. Bu sağlayıcıların sunucuları yurt dışında bulunabilir:
- Formspark — iletişim formunun iletilmesi
- Netlify — web sitesinin barındırılması
- WhatsApp (Meta) — fotoğrafların alınması ve iletişim
- Google — video üretiminde kullanılan yapay zeka araçları ve web yazı tipleri (Google Fonts)
Yurt dışına aktarım, KVKK m. 9 kapsamında formu gönderirken verdiğiniz açık rızaya dayanır. Verileriniz satılmaz ve pazarlama amacıyla üçüncü kişilerle paylaşılmaz.
5. Saklama süresi
Talep ve iletişim verileri, işlem tamamlandıktan sonra en fazla 2 yıl; fotoğraflar ve videolar teslimden sonra en fazla 6 ay saklanır, ardından silinir. Yasal saklama yükümlülükleri saklıdır.
6. Haklarınız (KVKK m. 11)
Verilerinizin işlenip işlenmediğini öğrenme, bilgi talep etme, düzeltilmesini veya silinmesini isteme, aktarıldığı üçüncü kişileri öğrenme, itiraz etme ve zararın giderilmesini talep etme haklarına sahipsiniz. Başvurularınızı info@pictoreel.com adresine iletebilirsiniz; en geç 30 gün içinde yanıtlanır.

2. Welche Daten wir verarbeiten
- Identität und Kontakt: Name, E-Mail-Adresse, Telefon- / WhatsApp-Nummer
- Anfragedaten: Kategorie, deine Nachricht, Name der Person, die dich empfohlen hat
- Bilddaten: Fotos deines Fahrzeugs oder Objekts, die du per WhatsApp sendest
- Technische Daten: IP-Adresse und Browserdaten, die beim Hosting der Seite anfallen (Server-Logs)
3. Zwecke und Rechtsgrundlagen
- Anfrage bearbeiten, dir antworten, Video erstellen und liefern — Vertragsanbahnung bzw. -erfüllung (KVKK Art. 5/2-c).
- Provision im Empfehlungssystem der richtigen Person zuordnen — berechtigtes Interesse (KVKK Art. 5/2-f).
- Sicherer und funktionierender Betrieb der Seite — berechtigtes Interesse (KVKK Art. 5/2-f).
Deine Fotos werden nur für dein Video verwendet und ohne deine ausdrückliche Erlaubnis nicht als Werbung oder Beispiel veröffentlicht.
4. Empfänger
Wir arbeiten mit folgenden Dienstleistern, deren Server sich im Ausland befinden können:
- Formspark — Übermittlung des Kontaktformulars
- Netlify — Hosting der Webseite
- WhatsApp (Meta) — Empfang der Fotos und Kommunikation
- Google — KI-Werkzeuge zur Videoerstellung und Web-Schriftarten (Google Fonts)
Die Übermittlung ins Ausland erfolgt auf Grundlage deiner Einwilligung beim Absenden des Formulars (KVKK Art. 9). Deine Daten werden nicht verkauft und nicht zu Werbezwecken an Dritte weitergegeben.
5. Speicherdauer
Anfrage- und Kontaktdaten speichern wir höchstens 2 Jahre nach Abschluss, Fotos und Videos höchstens 6 Monate nach Lieferung; danach werden sie gelöscht. Gesetzliche Aufbewahrungspflichten bleiben unberührt.
6. Deine Rechte (KVKK Art. 11)
Du hast das Recht auf Auskunft, Berichtigung, Löschung, Information über Empfänger, Widerspruch und Schadensersatz. Schreib uns an info@pictoreel.com; wir antworten spätestens innerhalb von 30 Tagen.

2. Data we process
- Identity and contact: name, email address, phone / WhatsApp number
- Request details: category, your message, name of the person who referred you
- Images: photos of your vehicle or property that you send via WhatsApp
- Technical data: IP address and browser data generated by hosting the site (server logs)
3. Purposes and legal bases
- Handling your request, replying to you, producing and delivering your video — conclusion or performance of a contract (KVKK Art. 5/2-c).
- Assigning referral commissions to the right person — legitimate interest (KVKK Art. 5/2-f).
- Keeping the site secure and running — legitimate interest (KVKK Art. 5/2-f).
Your photos are used only to create your video and are never published as advertising or examples without your explicit permission.
4. Recipients
We work with the following service providers, whose servers may be located outside Türkiye:
- Formspark — contact form delivery
- Netlify — website hosting
- WhatsApp (Meta) — receiving photos and communication
- Google — AI tools used for video production and web fonts (Google Fonts)
Transfers abroad are based on the explicit consent you give when submitting the form (KVKK Art. 9). Your data is never sold or shared with third parties for marketing.
5. Retention
Request and contact data are kept for no more than 2 years after completion; photos and videos for no more than 6 months after delivery, then deleted. Statutory retention obligations remain unaffected.
6. Your rights (KVKK Art. 11)
You have the right to access, rectification, erasure, information about recipients, objection and compensation. Contact us at info@pictoreel.com; we respond within 30 days at the latest.
